Judge Bans Use Of Illegal and Aliens
Judicial Watch Blog
Thu, 11/06/2008 – 17:10
Arizonas Supreme Court chief justice has agreed to enforce the Hispanic Bar Associations demands of banning the terms illegal and aliens in all of the states courtrooms.
Claiming that the terms are inflammatory, the president of Arizonas Hispanic Bar Association, (known as Los Abogados) has asked state Supreme Court Chief Justice Ruth McGregor to stop using them at trials or hearings because they create perceptions of judicial bias.
In a strongly worded letter to the chief justice, Los Abogados president says attaching an illegal status to a person establishes a brand of contemptibility, creates the appearance of anti-immigrant prejudice and tarnishes the image of courts as a place where disputes may be fairly resolved.
It further points out that no human being is illegal and that a national Hispanic journalism association has roundly criticized the reference for dehumanizing a segment of the population. The letter goes on to criticize the states High Court for using the term illegals in at least two opinions and the term illegal aliens in dozens of others.
It concludes with a list of acceptable and unacceptable terms relating to illegal immigration. Among those the group wants banned are; immigration crisis, immigration epidemic, open borders advocates, anchor babies and invaders. Among the acceptable terms are foreign nationals, unauthorized workers and human rights advocates. Click here to see the entire list as well as Chief Justice McGregors promise to enforce the requests.

Ridiculous
Uh, what a ridiculous example of political correctness. Shame on this state Supreme Court for caving in to the whacked out ravings of a Latino interest group. If they are not already, once word gets out more widely they will be a laughing stock among state Supreme Courts.
Hypersensitivity of this sort is not humane or enlightened, it is spineless and dehumanizing. It assumes that we are so easily offended that we must must be protected by Big Brother because we cannot deal with real people and make our own decisions when conflicts arise. It is reflective of an unhealthy paternalism which is destroying the fabric of what used to make America great, namely self-determination, hard work, and the moral bearings which arise from that.
And yes, the concept of citizen implies that it can be legal or illegal, based upon the laws that confer citizenship in any particular jurisdiction. If members of a Supreme Court do not understand this, we are in a lot of trouble as a nation. God help us all.

If the Hispanic Bar likes that, then let's call drug dealers undocumented pharmacists, and home robbery suspects physical property adjusters.

illegal aliens
The 9th Circuit Court of Appeals Justices: Sims, Raye and Hull, said in a decision:
“Defendants prefer the term undocumented immigrants. However,
defendants do not cite any authoritative definition of the term
and do not support their assertion that the terms undocumented
immigrant and illegal alien are interchangeable. We consider
the term illegal alien less ambiguous. Thus, under federal
law, an alien is any person not a citizen or national of the
United States. (8 U.S.C. 1101(a)(3).) A national of the
United States means a U.S. citizen or a noncitizen who owes
permanent allegiance to the United States. (8 U.S.C.
1101(a)(22).) Under federal law, immigrant means every alien
except those classified by federal law as nonimmigrant aliens.
(8 U.S.C. 1101(a)(15).) Nonimmigrant aliens are, in
general, temporary visitors to the United States, such as
diplomats and students who have no intention of abandoning their
residence in a foreign country. (8 U.S.C. 1101(a)(15)(F),
(G); Elkins v. Moreno (1978) 435 U.S. 647, 664-665 [55 L.Ed.2d
614, 627-628] [under pre-1996 law, held the question whether
nonimmigrant aliens could become domiciliaries of Maryland for
purposes of in-state college tuition was a matter of state
law].) The federal statutes at issue in this appeal refer to
alien[s] who [are] not lawfully present in the United States.
(8 U.S.C. 1621(d), 1623.) In place of the cumbersome phrase
alien[s] who [are] not lawfully present, we shall use the term
illegal aliens. ”

UNBELIEVABLE!
She must have gotten her law degree out of a box of Cracker Jacks because the term ILLEGAL ALIEN is correct and is specified numerous times in federal law, as well as who that term applies to. Calling an ILLEGAL ALIEN an “undocumented immigrant”, “unauthorized worker”, or “human rights advocate” not only is non-descriptive of the individual, it is the same as calling a burglar an “unwanted house guest”. GET REAL!
Maybe her court should be petitioned that we no longer call convicted felons “criminals”, since after all it has a negative connotation.

Sounds like groups
Sounds like groups representing illegals do not like being called what they are. USA has free speech. These special groups do not understand Free Speech OR USA laws that clearly define illegal aliens. Since when does USA limit language of our laws to please special interests? Either keep USA laws or leave. No speech limits on USA immigration laws.
Dictations from special interests and the bench are infringment of USA citizens rights and freedoms.
I propose the states pass laws that majority voted referendums can not be over ruled by courts/judges. This is what happened to Prop 187 in CA '96.
A strong majority voted to deny illegal aliens state sponsorship. A supreme court judge over ruled the peoples votes and it just lies unenforced. This type of power by courts/judges denies the most basic rights of citizens.
Public referendums passed by majority should never be over ruled by corrupt judges/courts. The denial of a public voted referendum appears to involve corruption. Vickie

If the illegal aliens and the anchor babies they drop think that just because we have elected a black President, that we are going to give our country over to them, they are wrong. Americans have a history of racism, however, we also have a history of banding together and getting things done. No amnesty, all illegal immigrants and the anchor babies they have dropped since 1986 should be made to leave our country soonest. Illegal aliens are ILLEGAL BECAUSE THEY BROKE IMMIGRATION LAW!!!
To Whom It May Concern,
Illegal aliens are called illegal because they broke Federal Immigration Law and breeched our U.S. borders to come here, and illegal aliens are NOT CITIZENS. Now, if the Latino community doesn't like the sound of the word illegal alien, then stop breaking our immigration laws to come to the United States. Stay in your own country, and remain a citizen of that country, OR IMMIGRATE TO THE U.S. WITHIN THE RULE OF LAW, AND DON'T BREAK IN LINE ON THOSE TRUE IMMIGRANTS THAT ARE IMMIGRATING TO THE U.S. LAWFULLY.
What sense does the term foreign national have? Is it a matter of semantics? No, I don't think so, the latino community if trying to shave off the words in our political and legal language to make them less abrasive in order to hide the naked truth that they (the illegal hispanic aliens are in the United States ILLEGALLY!!!!!!!!). It is full of crap to try and change the language of truth….If you are here illegally, then you are here illegally!!!! The bottom line in this country is, if I break the law, I am labeled a criminal, and if illegal hispanic aliens break the law to come to the U.S. by the tens of millions, then you ARE CALLED A F.ing ILLEGAL ALIEN.
If you don't want to be called that, then don't try to illegally immigrate to the United States. PERIOD.
Oh yeah, and ANCHOR BABIES ARE A TRUE PHENOMENON, and anchor babies are a way that illegal hispanic aliens get to be a citizen by breeching the border with baby in womb.

Illiegal Alien
Chief Justice? She doesn't qualify as a Justice of the Peace. How about she takes her judicious nonsense to its ultimate conclusion:
Pedophile infers prejudicial information that is inflammatory, as does serial killer, adulterer, thief, robber and just about any charged crime.
To be correct, her ruling would have to infer that being in a country illegally is not a crime, that it does not violate the laws of that country.
That this bloviating brief submitted by Los Albagados (which I incorrectly thought was a soup) carries enough weight to be seriously considered by the Supreme Court is overwhelmingly ridiculous.
Now a higher court will need to take the time to overturn this judge's ruling. Of course I assume that insanity doesn't completely prevail throughout the land.

JUDGE TRIES TO MANIPULATE AMERICANS MINDS BY MANIPULATING WORDS!
MY PARENTS ARE “IMMIGRANTS” – THERE IS JUST ONE MEANING FOR THIS WORD IN IMMIGRATION LAW: PEOPLE WHO COME WITH PRIOR PERMISSION. THIS MEANS INHERENTLY “LEGALLY”. THERE IS JUST ONE MEANING FOR “ILLEGAL ALIEN”: THOSE WHO COME IN VIOLATION OF THE LAW. CALLING AN “ILLEGAL ALIEN” (WHO SNEAKS, CHEATS, LIES AND USES PHONY DOCUMENTS TO STEAL AMERICAN JOBS, STEAL OUR BENEFITS THEY ARE NOT ENTITLED TO, ETC.) AN “IMMIGRANT” (PEOPLE WHO GET ON LINE AND WAIT THEIR TURN FOR YEARS, GET BACKGROUND CHECKS TO PROVE THEY ARE NOT CRIMINALS AND HEALTH CHECKS TO PROVE THEY HAVE NO CONTAGIOUS DISEASES) IS A GROSS INSULT TO ANY “IMMIGRANT”. THE LATTER WORD IS A RESPECTED WORD AND THAT IS WHY THE ILLEGAL SUPPORTERS TRY TO BULLY AMERICANS INTO USING THE WORD (IMMIGRANT) INSTEAD OF “ILLEGAL ALIEN” (WHICH TELLS IT LIKE IT IS). THESE MOSTLY “MEXICAN” GROUPS WHO HAVE A HIDDEN AGENDA (AZTLAN/RECONQUISTA) TRY TO MANIPULATE AMERICANS' MINDS BY MANIPULATING OUR WORDS. THEY CALL THE PATRIOTS WHO WANT PEOPLE TO COME HERE LEGALLY LIKE THE MINUTEMEN “RACISTS” WHEN IT IS THE MEXICANS WHO HATE THE GRINGOS (THEY EVEN HAVE QUOTES IN THEIR BOOKS THEY TEACH THEIR RAZA STUDIES WITH THAT SAY “KILL THE GRINGO” THAT IS BEING TAUGHT IN OUR PUBLIC SCHOOLS) AND ARE THE REAL RACISTS. MEXICO HAS AN AGENDA TO TAKE OVER THE SW (THOUGH MOST WANT THE ENTIRE U.S. NOW THAT THEY HAVE BETWEEN 38 MILLION AND 60 MILLION MOSTLY MEXICAN ILLEGALS HERE IN EVERY STATE) AND WITH OUR GOV'T HELPING THEM, THEY ARE QUITE SURE THEY ARE GOING TO ACHIEVE IT, THROW THE GRINGOS OUT AND MURDER ANY THAT DON'T LEAVE WILLINGLY. “If the Law supposes that, then the Law is a Ass”
Mr. Bumble in Charles Dickens' Oliver Twist had it right.
“Los Abogados president says attaching an illegal status to a person establishes a brand of contemptibility, creates the appearance of anti-immigrant prejudice and tarnishes the image of courts as a place where disputes may be fairly resolved.”
No, not ANTI-IMMIGRANT PREJUDICE. I assume most Americans have no problem with LEGAL immigrants. However, those who break our laws get and DESERVE the disdain of those who abide by those same laws. (It's called “social sanctions”, look it up.)
If “Los Abogados” fear that “illegal status” may undermine our courts' effectiveness in “fairly resolving disputes”, they have no faith in our judicial process at all, and should forthwith find other employment. If these lawyers think “illegal alien” influences a judge's rulings, or “accused murderer”, or “drunk driver”, they obviously have no belief in the impartial application of rule-of-law and therefore have no business at all being officers of the court.

Why not 1786?
Simple; the last mass amnesty was under Reagan in '86. Like magic, there was no illegal alien problem because with the wave of a wand, they were all re-categorized as citizens.
So… all of the fence-jumpers (as if we had a fence) *since* '86 are ILLEGAL and can be deported.
The more recent attempts have been successfully fought. The D party is becoming more crafty in how it hides such legislation, so I expect that it WILL occur again within the next 4 years, if not O's first 100 days.
Incidentally, my Mother is from N Ireland, and my grandparents from Hamburg and Stockholm respectively. All arrived here *legally*. My mother only became a US Citizen a year ago after taking the test and the requisite legal expenses. There is a BIG difference between a LEGAL immigrant who relinquishes ALL ties to a foreign country, and an ILLEGAL who has NOT renounced such allegiance.

It should have read:
Arizonas El Supremo Court chief justice has agreed to enforce the Hispanic Cantina Associations demands of banning the terms entrant and undocumented worker in all of the states courtrooms.
Claiming that the terms hit too close to home, the president of Arizonas Hispanic Cantina Association, (known as Los Albondigas) has asked state Supreme Court Chief Justice Ruth McGregor to stop using them at trials or hearings because they create perceptions of legal and acceptable behavior.
In a strongly worded letter to the chief justice, Los Albondigas president says attaching legal status to a person establishes a brand of contemptibility, creates the appearance of pro-immigrant prejudice and reinforces the image of courts as a place where bias and political pandering reign supreme.
It further points out that no human being is entitled to the rights and privileges set aside for it's citizens to those who enter a sovergin country illegally. The national Hispanic journalism association has roundly criticized the reference for humanizing a segment of the population. The letter goes on to criticize the states High Court for using the term undocumented workers in at least two opinions and the term entrants in dozens of others.
It concludes with a list of acceptable relating to illegal immigration. Among those the group wants enforced are;illegal aliens, aliens, criminals, immigration crisis, immigration epidemic, open borders advocates, anchor babies and invaders. Among the unacceptable terms are undocumented workers, unauthorized workers and human rights advocates and longterm univited tourists from the south. Chief Justice McGregors promises to enforce the requests.

Lunacy in Arizona
Regardless of how you feel about immigration issues, it's pretty obvious that Arizona Supreme Court Chief Justice McGregor is about as big a quack as they come.
Aren't the terms she's just “banned” found in numerous state and national documents, as well as academic literature on the subject? How is a judge or more to the point a lawyer supposed to operate under such draconian rules of judicial behavior?
Orwellian is the most obvious description of McGregor's embarrassingly dumb ruling. Someone should play the line from Plan 9 from Outer Space to the justice until she gets the message (“Stupid, stupid, stupid!”)
